Pedophilia (alternatively spelt paedophilia) is a psychiatric disorder in which an adult or older adolescent experiences a primary or exclusive sexual attraction to prepubescent children. Although girls typically begin the process of puberty at age 10 or 11, and boys at age 11 or 12, criteria for pedophilia extend the cut-off point for prepubescence to age 13. According to DSM-5-TR, a person must be at least 16 years old, and at least five years older than the prepubescent child, for the attraction to be diagnosed as pedophilic disorder.
Pedophilia is not a legal term, and having a sexual attraction to children is not illegal. In law enforcement circles, the term pedophile is sometimes used informally to refer to any person who commits one or more sexually-based crimes that relate to legally underage victims. These crimes may include child sexual abuse, statutory rape, offenses involving child pornography, child grooming, stalking, and indecent exposure. One unit of the United Kingdom's Child Abuse Investigation Command is known as the "Paedophile Unit" and specializes in online investigations and enforcement work. Some forensic science texts, such as Holmes (2008), use the term to refer to offenders who target child victims, even when such children are not the primary sexual interest of the offender. FBI agent Kenneth Lanning, however, makes a point of distinguishing between pedophiles and child molesters.
In a similar study, Habermeyer et al. (2013a) investigated eight pedophiles (three with a history of contact offenses, five with a history of child pornography consumption) and eight heterosexual teleiophilic controls in an event-related design consisting of erotic pictures of boys, girls, men, and women. In an ROI analysis including the middle frontal gyrus, only the pedophilic participants showed activation in the girl contrast, whereas controls showed deactivation (Habermeyer et al., 2013a). A further finding showed that during the immediate processing of erotic stimuli, both groups showed significant activations in the dorsomedial prefrontal cortex, a finding the authors attributed to the crucial role this region occupies in the critical evaluation of and attention to sexual stimuli (Habermeyer et al., 2013a).
The marriage of legal children, in fact, has been relatively common throughout U.S. history. The U.S. Census Bureau did not link age with marital status till 1880, which makes national figures unavailable before that time. But in that year 11.7 percent of fifteen-to-nineteen-year-old girls were wives (the census did not specify exact age and marital status till 1910). That number dipped in 1890 and then increased incrementally through the 1920s to 12.6 percent in 1930. Youthful marriage decreased, as did the overall marriage rate, during the Great Depression. It then rose again dramatically after World War II but has been declining since the early 1960s. That said, people below the age of eighteen continue to marry to this day. A2011 study published in the journal of the American Academy of Pediatrics estimates that about 9 percent of contemporary American women were married before they turned eighteen. Many of those women are now older, having married in the 1950s or 1960s, but they are not women of the distant past; they live among us today. The Centers for Disease Control estimates that the probability of marrying by age eighteen in the contemporary United States is 6 percent for women and 2 percent for men.
For most of American history there was no distinction between the marriage of two minors or that between one party who was older (sometimes considerably so) and one who was younger. Once contracted, marriage has been, and largely remains, a one-size-fits-all institution. Culturally and socially, however, observers may react very differently to these phenomena, understanding the former as perhaps foolhardy, whereas the latter could be dangerous or exploitative. Contemporary observers may recoil when an older man marries a girl below the age of eighteen because they suspect him of pedophilia. Marriage, in this analysis, is simply a back door to that which is illegal outside of it, especially when divorce is widely available; the man can simply divorce the underage girl when he tires of her (or when she ages). These concerns are not invalid, but they were usually not shared by Americans before the twentieth century, who were far more concerned that premarital sex led to the ruin of girls who would be unable to marry and might thus be destined for lives of prostitution. Before the 1920s, most people also did not share our understanding of pedophilia, the sexual predilection of some adults for children. Because of this, most objections to the marriage of girls (or boys) would not have been framed around the issue of sex or sexual exploitation. Instead, early critics of youthful marriage worried that it robbed girls of girlhood or that it might lead to divorce. Although I never dismiss the very real imbalance in power that characterized marriages with great age disparities, in this book I also explain why earlier Americans did not necessarily see this as a problem and offer historical context for how and when Americans came to see man-girl marriage as sexually suspect.

To be clear, sexual curiosity in children is normal. All children explore their bodies and may engage in visual or even manual exploration of a sibling at times. This is one way that children discover sexual differences between boys' and girls' anatomies. Even siblings of the same gender become curious about variations in shapes and sizes of their sex organs. Two small children exploring each other's bodies does not predestine them to a life of emotional suffering.
Today, many modern Muslim countries have legislated to raise the minimum age of marriage, in many cases to the age of 16 or 18 for girls (though often with loopholes or with ineffective enforcement) and to prevent forced marriage, often in the face of opposition from Islamic scholars. Many Muslim campaign groups and charities have been involved in this process and continue to offer help to those at risk (see the article Forced Marriage which includes sources of help). In collaboration with activists, in 2019 the deputy Grand Mufti of al-Azhar University in Cairo issued a fatwa calling for marriage based on mutual consent with a minimum age set as 18. Unicef say that the prevalence of child marriages are decreasing globally but are nevetheless common (including among non-Muslim populations in some regions of the world).
Delaying the marriage of girls in many Muslim countries is something new and contradictory to what Muslims used to do over many centuries. This is because of westernization and the application of man-made laws. This caused a change in understandings and customs within a considerable number of the population, and it is absolutely not permissible to consider the customs and traditions in a given country as the standard by which people abide, and fail to obey the absolute evidences of Shariah.
In some Muslim countries, the marriage for girls has been delayed by many years beyond the age of puberty. This has indeed led to an increase in the removal of the veil from the face, and increased fornication and adultery, as well as the emergence of deviation in conduct and religion among the youth. They had become morally unstable as they lack affection, chastity, and protection their private parts from illegal sexual relations.
In contemporary law enforcement definitions, the term "pedophile" is generally used to describe those accused or convicted of the sexual abuse of a minor. Pedophilia is considered a taboo and is illegal in most societies, cultures and religions; except in the Islamic world with regards to Islam.
